Heard this on morning radio. A woman in France who was six months pregnant lost her baby to the carelessness of a doctor who confused her with another patient needing a contraceptive coil removed.
She has taken the doctor to Frnch courts but has failed to convict him as they feel that their homicide laws do not apply to the unborn child, as a fietus has no rights. She is now attempting to prosecute the doctor though the european court of human rights.

Well, not knowing the details of the case, I assume you mean she wants the doctor tried for murder. If that's true, then the French woman hasn't a leg to stand on. You cannot murder anything but a human being. And, as horrible as this is to say, a fetus is not a human being.
Now, I'm sure she can get a hell of a malpractice suit going. Just not a criminal one.
I tried to find this story, but I can't. Do you know where it appears?

It would be interesting to see what the French murder laws are. Under US law, it would depend what state you were in to determine whether or not she has a cause of action criminally, although my instinct tells me he wouldn't be prosecuted. Our authorities would leave this to the civil courts for a malpractice suit. Wonder if France has that?
